  • CityCenter Construction Litigation; Mr. Robertson represented the Owner of Project CityCenter in Las Vegas, Nevada in one of the largest construction defect lawsuits in the country.  CityCenter, the largest privately funded construction project in the history of the United States, is located on 67 acres between the Bellagio and Monte Carlo resorts.  CityCenter includes Aria, a 61-story, 4,004 room gaming resort; luxury non-gaming hotels including the Mandarin Oriental and Vdara Hotel & Spa; Veer  Towers, the development’s only strictly residential buildings; and Crystals, a 500,000 square foot retail and entertainment district.  CityCenter is a joint venture  between MGM Resorts International and Infinity World Development Corp., a subsidiary of Dubai World. Robertson obtained a settlement of $195,000,000 for his client.
     
  • Voggenthaler v. Al Philips The Cleaner , et al., U.S.D.C. Case No. 2:08-CV-01618;  In 2010 the Firm obtained summary judgment in federal court for injunctive relief under the Resource Conservation Recovery Act (R.C.R.A.) ordering the former and current owners of a shopping center to clean-up a 4,000 foot long plume of PCE (a common dry cleaning solvent) which had been released from a dry cleaner tenant into the shallow groundwater.  The Firm represented  274 homeowners who lived down gradient from the shopping mall in a class action which was certified by the Clark County District Court as a class action.  The Firm’s experts estimated that value of the clean-up effort, which will take several years to complete, at over $20,000,000.  In addition to obtaining the injunction forcing the responsible parties to clean up the hazardous waste, the Firm recovered $2,500,000 in diminution-in-damages by settlement for the homeowners who live above the plume.
     
  • Ilikai Condotel Securities Fraud Case;  In 2009 the Firm represented approximately 50 purchasers of condo-hotel units at the iconic Ilikai Hotel in Waikiki, Hawaii, who alleged they were defrauded by developer and promoter.  Although the target defendant filed for Chapter 11 Bankruptcy protection during the litigation, the firm was able to successfully negotiate a settlement with the debtor, its insurers and the Bankruptcy Trustee, which resulted in Bankruptcy Trustee approving allowed claims totaling approximately $2,900,000 for the Firm’s clients.
     
  • Four Turnberry Place Condominium Association v. Turnberry Pavillion Partners, et al., Clark County District Court Case No. A572789;  In 2010 the Firm successfully obtained a settlement of $6,300,000 for the HOA of a 50-story luxury highrise in Las Vegas, Nevada for construction defects against the developer and its subcontractors.
     
  • Canyon Gate Maintenance Assoc. v. City of Santa Clarita, D. R. Horton Los Angeles Holding Co., L.P., Los Angeles Superior Court case no. BC407614;  This is an inverse condemnation case against the City and a fraudulent concealment case against the developers and builders involving a regional landslide that affects the 61 acre development known as CANYON GATE, a subdivision consisting of 148 single family homes in Santa Clarita, California.
     
  • Bellagio, LLC. v. Laticrete International, et al. Clark County, Nevada No. A471037;  Successfully represented owner of five diamond luxury hotel and casino in construction defect/mold case against general contractor, subcontractors and product manufacturer arising from $40 Million repair and remediation of 2,600 guest rooms.
     
  • Ed McMahon v. American Equity Insurance Company Los Angeles County, California, No. BC 271423; Obtained largest published settlement of its kind for entertainer and his wife against insurer for bad faith claims practices and negligent remediation of mold contamination of McMahons’ Beverly Hills, CA., residence.   • The County of Nye, State of Nevada v. Modern Controls & Refrigeration, Inc., et al. Clark County, Nevada No. A448475;  Successfully obtained $1,850,000 recovery on behalf of Nye County against general contractor, subcontractors and design professionals for defective HVAC system, which resulted in evacuating brand new courthouse, sheriff facility and 911 dispatch center in Pahrump, Nevada shortly after construction.
     
  • Hidden Canyon HOA v. Griffin Homes Ventura County, California No. 113150;  Obtained $9,782,500 settlement for 648 unit condominium association for construction defects against homebuilder.
     
  • Carlton Square HOA v. John D. Lusk & Sons, et al. Los Angeles County, California No. YC020074;  Successfully obtained $8,500,000 settlement against homebuilder for construction defects in 478 unit condominium association.
     
  • Spectrum Community Association v. Bristol House Partnership, et al. Orange County, California No. 00CC07398;  Successfully represented 200 unit condominium association for construction defects and approximately 200 families who resided in complex for personal injuries sustained from exposure to mold. Recovered $8,400.000 settlement.

  • Camarillo Miramonte Homeowners Association v. Castle & Cooke Homes, Inc. Ventura County, California No. CIV 180 159;  Successfully represented 121 condominium association against homebuilder for construction defects, including soils issues, and obtained $2,985,000 settlement.
     
  • Weber Madgwick Excavating, Inc. v. Cal Fed Bankcorp, Inc. American Arbitration Association No. 72Y1100027196;  Successfully obtained verdict against Cal Fed Bank for fraud and breach of contract, including punitive damages, arising from wrongful termination of grading contractor lender hired to repair landslide in Bel Air, California. Verdict $1,161,667.
     
  • Zilinskas v. American Geotechnical, Inc. Los Angeles County, California No. SC 028842; Successfully defended geotechnical engineering company at trial against professional negligence case arising from massive landslide in Ramirez Canyon, Malibu, California.
